Workers' Compensation — Frequently Asked Questions

Do I need workers' compensation insurance?

In most states, yes — if you have employees (even one), you're required to carry workers' compensation insurance. The threshold varies by state: some require coverage for 1 employee, others for 3 or 5. Trucking companies, construction firms, and warehouses are almost always required to have it regardless of employee count. We'll check your state's requirements and make sure you're compliant.

How much does workers' compensation cost?

Workers' comp premiums are based on your industry classification code (NAICS), payroll size, claims history, and state regulations. Typical rates range from $0.50 to $5.00 per $100 of payroll, depending on risk. Trucking and warehousing are moderate-risk ($1.50–$3.50 per $100), while construction can be higher ($3.00–$8.00+ per $100). We shop multiple carriers to find the lowest rate for your classification.

What is Experience Modification Rate (EMR) and how does it affect my premium?

Your EMR is a multiplier based on your past 3 years of claims history. An EMR of 1.0 is average. Below 1.0 (e.g., 0.75) means you have fewer claims than average and gets you a discount. Above 1.0 (e.g., 1.25) means you have more claims and your premium increases. A high EMR can add 20–50% to your premium. We help you manage claims proactively to keep your EMR low and your premiums down.

Do owner-operators need workers' compensation?

If you're a solo owner-operator with no employees, most states exempt you from workers' comp. However, if you have any drivers or helpers, you're required to cover them. Some owner-operators choose to purchase an occupational accident policy as an alternative — it provides similar coverage (medical, lost wages, disability) for the owner-operator and any leased drivers, without the full workers' comp premium. We'll help you determine the best option.

What happens if an employee gets injured on the job?

Report the injury to us immediately — our emergency claims line is available 24/7. We'll help you file the claim with your carrier, ensure the employee gets proper medical treatment, and manage the claims process. We advocate on your behalf to keep costs down and get your employee back to work safely and quickly. Proper documentation and timely reporting are critical to a smooth claim.

Can I get workers' comp for independent contractors?

Independent contractors are generally not covered by workers' comp — they need their own insurance. However, if a worker is misclassified (they're really an employee but labeled as a contractor), you could be liable for uncovered injuries and face penalties. We can help you review worker classifications and recommend the right coverage structure to protect your business.

Do you offer safety consulting to help reduce claims?

Yes. Reducing workplace injuries is the best way to control your EMR and keep premiums low. We offer safety assessments, OSHA compliance guidance, return-to-work program design, and accident investigation support. Many of our carrier partners also provide safety resources at no additional cost. A proactive safety program pays for itself in lower premiums.
